The Ministry of Commerce acknowledges that China’s international trade friction is increasing

The Ministry of Commerce released a message on November 14th that since joining the World Trade Organization (WTO) in 2001, China and Europe and the United States and other developed countries and some developing countries have become increasingly fierce in trade competition, trade frictions are increasing, and WTO dispute settlement cases are also rapidly increase. Since joining the WTO, China has filed 11 lawsuits under the WTO dispute settlement mechanism, involving 11 disputes, mainly targeting developed members such as the United States and the European Union; 29 cases have been filed involving 18 disputes. In addition, China has participated in 92 WTO disputes as a third party. The information released by the Ministry of Commerce is actually a supplement to the views of Minister of Commerce Chen Deming a few days ago. On November 10, at the press conference of the 18th National Congress of the Communist Party of China, Chen Deming said, "In the trade dispute between China and the United States, the United States has complained about China, the United States has won more, and China has lost more. This is not true." He said that China also has a large number of cases in the WTO against the United States, and we have won a lot, but it is not as publicized as some people. "Recently, we have resorted to the WTO's misconduct in China's 22-category product countervailing investigations. I have a greater grasp of the win, because in the previous similar cases, the United States has lost the case." The Ministry of Commerce further explained this. Since this year, China has resorted to the US anti-subsidy legislation and more than 20 countervailing rulings, as well as discriminatory subsidies for minority members of the European Union on photovoltaic power generation, to resort to the WTO dispute settlement mechanism. The Ministry of Commerce said that the WTO dispute settlement mechanism has always been an important platform for safeguarding the legitimate rights and interests of the country and the industry. On the basis of in-depth research and adequate preparation, it has actively resorted to the trade protectionism measures adopted by the United States and Europe to the WTO dispute. The settlement mechanism has achieved a series of major achievements. In China v. US anti-dumping and countervailing WTO disputes (DS379), the WTO Appellate Body clarified the meaning of “public institutions” and “double relief” and ruled that the US anti-dumping and countervailing measures against China violated the rules. This victory effectively forced the United States to revise its domestic legislation. In the case of the US Poultry Restriction Measures (DS392), the expert group fully supported the Chinese claim that the US legislation restricting poultry importation violated WTO rules and the United States was forced to abolish its relevant legislation. In the case of China v. EU fastener anti-dumping measures (DS397), the Appellate Body ruled that the EU's "Anti-dumping Basic Regulations" on the "single tax rate" violates the provisions of the WTO Anti-Dumping Agreement. The EU was forced to revise its anti-dumping laws and re-examine 53 anti-dumping measures against China. In the case of China v. US anti-dumping and zeroing measures (DS422), the panel ruled that the US’s “zeroing” in the anti-dumping investigation of my frozen warm water shrimp and diamond saw blades violated WTO rules and won fairness for Chinese enterprises. treatment. In order to fulfill the obligations of WTO members, the Ministry of Commerce and other central government departments have cleared laws and regulations, promoted the implementation of WTO rules, and fulfilled various obligations such as transparency. This has also promoted China's legal system construction. At the same time, China respects the results of the WTO ruling and is active. Promote the smooth implementation of the dispute in the dispute case.
